When an incorrect company name has been lodged via a company registration form, should a Form 492 or 205A be lodged to correct the error?
Answer
Whilst NowInfinity cannot specifically advise which form is best for your circumstances, please note the following:
If a Form 492 mistake correction form is used to amend ASIC's records, you may also amend the company registration documents, which will enable you to edit and regenerate the company registration documents with the correct name.
Using the Form 492 also allows the option to have the ASIC certificate reflect the updated name, this would need to be requested with ASIC directly.
Note: ASIC only accept 492's correcting the company name if lodged within 24 hours of registration, unless advised by ASIC directly. The option to call ASIC directly within the 24 hours is also available.
If on the other hand, a Form 205A Company name change form is used, the option to update the company registration documents with NowInfinity is not available.
A new ASIC certificate with the updated name will not be issued, since the change of name certificate is used in place of this. This is to be kept for record keeping purposes.
