Question
How can I update the name of a Shareholder or Officeholder?
Answer
When a Shareholder or Officeholder requires an update to their name, there are ASIC form options available, depending on the circumstances.
If a Shareholder or Officeholder's name was recorded incorrectly with the Company, for example if there was a spelling error or a middle name was left out, this can be corrected by submitting a Form 492.
If the name has updated due to a legal name change such as a marriage, a Form 484A2 can be used.
If using the 484A2 form, it will ask for details below:
- Form Details - Provides an overview of the Transfer of Shares form
- Company Details - Reflects the Company Name, ACN and an option to select whether the Share Issue is in response to an Annual Statement. This information will be prefilled.
- Date of Change - Field that indicates when the Officer/Shareholder name was officially changed.
- New Name - Input the corrected name of the Officer/Shareholder who changed their name in the format provided.
If the 484A2 form rejects with code 'V490: Share holding already exists - The change of member name matches to an existing member in this joint shareholding', this likely means a 492 form will require to be used instead, as the name intended to be changed to, is too similar.
