Why isn't the trust deed dated?

Answer

The trust deed should be dated after all parties have signed. The settled/initial sum must be paid on or before the date of the deed.

The date of establishment of a unit trust is the date of the deed ("Commencement date").

The date of establishment of a discretionary trust is the later of the date of the deed or the Commencement Date specified in the Schedule to the deed.
