NowInfinity and the wider industry welcome the announcement from the Australian Securities and Investments Commission (ASIC) regarding the update to the Electronic Lodgement Protocol, which now permits electronic signatures on Form 362.
This update allows ASIC Registered Agents to collect and store Form 362 electronically, effective immediately.
Officeholders can sign Form 362 electronically by either:
- physically signing on a touchscreen device (e.g., with a stylus or finger), or
- digitally inserting an image of their usual signature.
There is no change to the method for agents to lodge the form electronically, and the option to physically sign a paper version of the document remains available.
Other requirements related to record keeping and producing Form 362 upon request by ASIC also remain unchanged.
The electronic signing functionality will be available for the Form 362 via NowInfinity as of Friday 11, April 2025.
