When updating the Responsible Person via the Form RA01, the outgoing Responsible Person does not have to sign. Why is that?
Answer
The Responsible Person is the person accountable for the performance of the obligations under ASIC’s Registered Agent Terms and Conditions. This Responsible Person must:
- Be over 18 years of age and reside in Australia, and if the ASIC Registered Agent:
- Is a company – the Responsible Person must be currently registered with ASIC as an officeholder for that company, or
- Has a registered business name and is not a company – the Responsible Person must be currently registered with ASIC as the business name holder or a representative for that business name registration.
