Is it possible to register a Business Name using the name of an existing Company?
Answer
Generally, a company name cannot be identical to an existing name. However, there are certain scenarios in which you may be able to register an existing name for a company e.g. the individual holder is also proposed to be the company's director or member, then the name may be available to the proposed company.
To apply for a business name, you will generally need to have an ABN. According to ASIC's website, multiple business names may be held by the same entity under the one ABN.
