Can the Registered Office address be a foreign address?

Question

Can the Registered Office address be a foreign address?

Answer

No, the Registered Office address must be an Australian address as per ASIC rules.

An Australian company must have an Australian Registered Office to receive correspondence. The registered address does not however need to be the same as the Company’s Principal Place of Business.

If the Company does not occupy the premises, the owner/occupier of the address must give written consent to use the address as the registered address of the Company.

There are several requirements for registered addresses, including:

  • Registered Address must be in Australia
  • PO Box is not allowed
  • Can be occupied by another entity
