What is a Superannuation Unrelated Investment Trust?

A SUIT is a type of trust specifically structured to facilitate investment by a complying self managed superannuation fund as a unitholder. It is an unrelated unit trust, where the trust has satisfied specific criteria so as not to be classified as a ‘related party’ to the members of the SMSF, under the ‘in-house asset’ rules as contained in the Superannuation Industry (Supervision) Act 1993. The trust deed should be considered a fixed trust for tax purposes, however it will not be a fixed trust for NSW land tax purposes.
